ARTICLE ON PRETRIAL RELEASE BY W. DAVID BALL

Santa Clara Law Professor David Ball has a forthcoming NYU Law Review article on the topic of preventive detention of arrestees and whether pretrial decisions can truly be made in a vacuum, or are influenced by unconscious psychological bias. “The human tendency to desire certainty and simplicity may help explain why our default seems to be to keep someone locked up, ‘just in case’—and why this desire is resistant to information and argument,” writes Ball.
